A Notary Public is a public officer appointed by a state government to help deter fraud. Notary Public’s duties involve witnessing the signing of important documents, verifying the identity of signers, ensuring they understand the contents of the document and are not signing under duress or coercion, and then notarizing the document with a special seal to validate the signatures.

 

A Loan Signing Agent, a specialized type of Notary Public, plays a critical role in the execution of loan documents. They ensure that real estate loan documents are executed by the borrower, notarized, and returned for processing on time. This includes explaining each of the loan documents to the borrower, witnessing their signing, and notarizing the appropriate sections. Loan Signing Agents must be impartial witnesses and cannot offer legal advice or personal opinions about the loan agreements.

Forming a Limited Liability Company (LLC) requires several important steps. First, you must select a unique name for your business, complying with your state’s LLC naming rules. Then, you file the Articles of Organization with the state’s Secretary of State office and pay the necessary filing fees. The articles typically include details such as the name of the LLC, its purpose, and information about its members. Most LLCs will also need to create an Operating Agreement, outlining the ownership structure and operational procedures of the LLC. You’ll need to obtain an Employer Identification Number (EIN) from the IRS, which is used for tax purposes. Depending on the nature of your business and where it is located, you may also need to obtain other local and state business licenses and permits. Lastly, you should open a business bank account to keep your business finances separate from personal ones, reinforcing the liability protection offered by an LLC structure.
